Refund, Cancellation & Booking Policy
This policy applies to all services and products supplied by DT Health and Fitness Solutions Ltd (company number 15769337), trading as DT Fitness London.
1. Cancellation and Rescheduling of Sessions
1.1 Notice required: At least 24 hours' written notice before the scheduled start time. Written means email to info@dushyantatomar.com or WhatsApp / text message to your trainer. Verbal notice is not accepted.
1.2 Late cancellation and no-shows: Any session cancelled with less than 24 hours' notice, or not attended without cancellation, is immediately and irrevocably forfeited. No refund, credit, or replacement session will be given. No exceptions.
1.3 Lateness: If you arrive late, the session ends at the originally scheduled time. No extension. Full session fee applies.
1.4 Rescheduling: Sessions cancelled with valid 24-hour notice should be rescheduled within the same programme week, subject to availability. We cannot guarantee specific time slots.
1.5 Trainer cancellation: If we cancel, we will offer a like-for-like replacement. Where a replacement cannot be agreed within a reasonable time, a pro-rata credit will be applied.
2. Session-Based Packages
2.1 Payment: All packages must be paid in full or on the agreed instalment schedule before sessions are delivered.
2.2 Session expiry: Sessions expire at the end of the programme period confirmed in your booking email. Expired sessions are non-refundable unless the expiry was caused by our failure to make sessions available.
2.3 Early termination by you: No refund for completed sessions or sessions forfeited under clause 1.2. If we agree (as an exceptional matter) to cancel remaining unused sessions, any refund will be calculated on unused sessions only, less a £30 administration fee.
2.4 Termination by us: We may terminate immediately and without refund for material breach. Genuinely unused and unexpired sessions may be refunded at our discretion less the £30 administration fee.
2.5 Grounds that are not grounds for refund: The following do not entitle you to a refund in any circumstance: dissatisfaction with results; failure to achieve personal goals; change of mind; lifestyle changes; relocation; injury caused otherwise than by our negligence; or any factor outside our reasonable control.
3. Subscriptions (Online Coaching)
3.1 How to cancel: Email info@dushyantatomar.com at least 7 days before your next payment date. We will confirm cancellation in writing.
3.2 Cancellation terms by subscription:

3.3 Access: You retain access until the paid period expires. No further payments after confirmed cancellation.
4. Personalised Diet Plans - Digital Products
4.1 Delivery: By email and download link (PDF), typically within 5 minutes of payment and submission of your information.
4.2 Cooling-off right: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel a distance purchase of digital content. This right may be waived before delivery commences.
4.3 Waiver at checkout: Before completing your purchase, you will be required to consent to immediate generation and delivery of your personalised plan and acknowledge that you waive your 14-day cancellation right once delivery begins.
4.4 Non-refundable once delivered: Once your plan has been generated and delivered, it is non-refundable without exception.
4.5 Statutory rights for faulty products: Nothing above affects your rights under the Consumer Rights Act 2015. If your plan is materially not as described, not of satisfactory quality, or was not delivered due to a technical fault on our part, contact us within 14 days at info@dushyantatomar.com.
4.6 No money-back guarantee: We do not offer any money-back or results guarantee on this or any other product or service.
5. How to Book
5.1 Bookings can be made via our Website booking form, Calendly link (where provided), or by emailing info@dushyantatomar.com.
5.2 A booking is confirmed when we send you written confirmation. No booking exists before confirmation is received.
5.3 We reserve the right to decline any booking at our absolute discretion, including where health screening has not been completed or where capacity is unavailable.
6. Before Your First Session
6.1 Before your first personal training or online coaching session, you must: complete our PARQ honestly and in full (this is mandatory); disclose all relevant health information; and provide written medical clearance from your GP where required (including for cardiovascular conditions, recent surgery, and pregnancy).
6.2 Services will not commence until these requirements are met.
7. Payment Disputes
Any dispute about a charge must be raised with us within 14 days of the payment being taken. We will not entertain any dispute raised outside this period.
8. Your Statutory Rights
Nothing in this policy affects your rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Services must be delivered with reasonable care and skill.
9. Refund Process
Email info@dushyantatomar.com with your name, purchase details, date, and reason. We will respond within 14 days. Approved refunds will be returned to the original payment method within 14 days of approval.
10. Governing Law
This policy is governed by the laws of England and Wales.
